GENERAL TERMS & CONDITIONS

1. These General Terms & Conditions shall govern the legal relationship with European Dreams(Travel Definition SAS) and our esteemed clients for all our tours and excursions listed. All services of third party suppliers are only brokered by European Dreams. These services are provided in the name of the relevant third party supplier in accordance with their general terms & conditions. These conditions are available on request at the time of definite bookings.

2. BOOKING

Bookings shall be accepted as long as the requested services are available at the moment of final reservation and the clients are of legal age. Bookings shall only be deemed to have been confirmed following receipt of the requested deposit payment. In confirming the booking, the client including his/her accompanying party shall be deemed to have consented to the General Terms and Conditions set forth below and declares that he/she has received the General Terms and Conditions.

3. PRICING

European Dreams pricing includes the specified program, reconfirmation of all agreed services prior to the start of the client’s travel, checking of flight information and train schedules as well as a 24/7 emergency telephone service. All rates mentioned in the offer are in Euros and include service, taxes and VAT. European Dreams reserves the right to modify/increase the price and or the program under certain unavoidable circumstances like natural disasters, strikes, accidents etc. and or increase in the fuel prices or in the exchange rate.

4. PAYMENTS & DEPOSITS

The booking of the trip will be considered final after a mail of agreement of our offer and the signature of a contract, a copy of which will be returned to European Dreams accompanied by a payment of a deposit of 30% of the total amount of the trip. The balance must reach us at least 60 days before the date of arrival. In case the reservation is made within 60 days, the full payment is due on agreement of our offer. All reservations must be accompanied by a copy of the participant’s valid passport. Wherever the visa is applicable, a copy of the visa should be sent as soon as the same is delivered by the competent authorities.

4.1 Bank Transfers

Bank transfers only in Euros (EUR) into the bank account indicated below are required. Bank transfers must be made without any charges for the beneficiary.

5. CANCELLATION PACKAGES

Notice of cancellation must be given in writing (which also includes email) by the clients on working days from Monday to Saturday to European Dreams and valid only on reception of a confirmation sent by European Dreams. In the event that a package is cancelled up to 60 days prior to the start of the holiday, an administration fee of 10% of the total pre-paid amount, subject to a minimum of 700 €, shall be charged. After this date the following penalties shall apply:

- 60 – 30 days prior to the start of the holiday
................................. 30%

- 29 – 16 days prior to the start of the holiday
................................. 50%

- 15 – 6 days prior to the start of the holiday
................................. 80%

- 5 days or fewer prior to the start of the holiday
................................. 100%

Once issued, any flight or train tickets are non-modifiable neither refundable.

6. COMPLAINTS

Complaints must be submitted in writing (which also includes email) to European Dreams or to their representants immediately on the spot in order to resolve the issue with those affected. If the complaint is received after the client’s departure, no compensation will be payable.

7. UNFORESEEN EXTENSION

In the unlikely event of any unforeseen extension to the program caused by flight delays or cancellations, bad weather, strikes, pandemics / epidemics or any other cause (non-exhaustive list) beyond the control of European Dreams, it is acknowledged that any expenses relating to the circumstances (accommodation, transfers etc.) shall be billed to the client in full. European Dreams accepts no liability for any changes, omissions, strikes or communication breakdowns etc. No entitlement shall arise to claim damages against European Dreams.

8. RENOVATIONS

Please be aware that hotels and venues may undertake renovations from time to time so as to maintain the high quality of their establishment, but that they will do all possible to limit any disturbances to their clients. If European Dreams is specifically informed of any renovation work, clients shall be informed accordingly. However, the dates and duration of such renovation works are subject to change. European Dreams will not be responsible for any inconvenient caused and no complaints or requests for refunds will be accepted if renovations are going on whilst the client is residing.

9. RESPONSIBILITY

Unless required otherwise by law, European Dreams declines all liability whatsoever for any loss,damage, injury, illness, accidents, delay or any other irregularity (non-exhaustive list) howsoever arising or for consequential losses, lost profit, the failure to enjoy the holiday or any other similar claims. Liability shall be limited under all circumstances to double the contractual price. European Dreams shall make every effort to ensure that all arrangements and services are carried out as specified in the most efficient and effective way possible. However, European Dreams does not have direct control over performance by suppliers and, whilst they are in all cases selected with the utmost care, European Dreams does not accept any liability for errors and omissions by such suppliers.

10. FORCE MAJEURE

European Dreams cannot accept any liability or pay any compensation where the performance or prompt performance of contractual obligations is prevented or affected, or the client otherwise suffers any damage or loss, as a result of “force majeure”. If the customer ends the journey early, he/she shall have no entitlement to any reimbursement and shall bear the costs of return travel. In these General Terms & Conditions “force majeure” means any event that European Dreams or the supplier of the service(s) in question could not, even exercising all due care, have foreseen or avoided. Such events may include armed conflict or the threat there of, rioting, civil war, terrorist activity or severe terrorist threats, industrial action, natural or nuclear disasters, pandemics /epidemics, adverse weather conditions, fires and all similar events (non-exhaustive list) beyond the control of European Dreams.

11. DATA PROTECTION POLICY

In order to process the bookings and to ensure that the arrangements meet client’s requirements, European Dreams will receive the travellers’ personal data from the client or from a third party. The client and the third party warrant to European Dreams and shall ensure that he/she is entitled to collect and disclose these personal data. European Dreams is subject to French data protectionlegislation. Appropriate data security arrangements have been put in place. In particular, personal data shall only be disclosed to third parties insofar as necessary for the arrangement booked.

12. APPLICABLE LAW, PLACE OF JURISDICTION

French law (excluding the provisions on the conflict of laws) shall be applicable. The place of jurisdiction is Mulhouse, France.
